Wage & Hour Rights and Responsibilities
Wage Payment: Employee rights include:- Pay for all salaries made (INFO # 3) at the rate consented to by the company and worker.
– Pay of at least minimum wage (INFO # 1), the relevant Colorado or regional base pay, and all made overtime earnings without impermissible deductions from their wages;.
– Pay of all made incomes without impermissible reductions (INFO # 16).
Labor Statutes, Rules, & Published Guidance
Statutes & Rules: DLSS imposes a lot of Colorado’s wage and hour and other kinds of labor statutes and labor rules, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Spend For Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules websites for existing and prior versions of essential Colorado labor statutes and guidelines.
Published Guidance: The Division’s main types of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notices, opinions, and descriptions on different labor law topics; and.
– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for workers on their labor rights.
Written Demands, Complaints, & Investigations
Demands & Complaints for Wages: If an employer owes you incomes, you can send your company a written demand for of wages by mail, e-mail, text, or other electronic means. A written demand may be sent to the company at the exact same time a Labor Standards Complaint Form for unpaid salaries is submitted with the Division. The Labor Standards Complaint Form can be discovered on our Demands, Complaints, Responses, and Settlements web page.
Employer Responses in Investigations: Once a total Labor Standards Complaint Form is gotten and evaluated, a letter explaining the nature of the problem and the quantities declared to be owed is sent out to the employer. Investigations Launched by the Division (” Direct Investigations”): The Division might perform employer-wide direct examinations of possible violations of Colorado wage and hour law. If you wish to send a suggestion, please email the Division at cdle_di_tips@state.co.us. If you would like to submit an individual claim for unsettled salaries, you should submit a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct investigation citation or several Notices of Assessment, an alleged employer may submit a Direct Investigation Appeal Form.
